1. DEFINITIONS

  • “Website” refers to punctumnews.com.

  • “Contributor” means any registered user who uploads photos or videos to the Website.

  • “Customer” refers to any person or entity purchasing or downloading media from the Website.

  • “Content” refers to images, videos, or other media uploaded to the Website.

  • “License” refers to the rights granted to Customers upon purchase or download.

  • “Subscription” means a recurring payment plan allowing for multiple downloads during a set time period.

  • “Single Download” refers to a one-time purchase of a content item.

 

2. ACCEPTANCE OF TERMS

By registering for an account, uploading content, or purchasing media, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our [Privacy Policy].

 

3. ACCOUNT REGISTRATION

  • Users must be at least 18 years old.

  • Contributors must provide accurate PayPal details for payout purposes.

  • Customers must use a valid payment method via our payment partner, Stripe.

 

4. LICENSE TERMS

  • All content is provided under a non-exclusive, non-transferable, limited license.

  • Licenses are available for editorial use only (e.g., news articles, blogs) or personal use.

  • Commercial use, resale, or redistribution of any content is strictly prohibited unless explicitly allowed by the license.

  • All content intended for editorial use is considered archival two days after the date indicated in the title or description.

 

5. CONTRIBUTOR TERMS

  • Contributors retain ownership of their uploaded content.
  • By uploading content, you grant Punctum News the right to distribute, market, and license your content to third parties.
  • Titles, descriptions, and tags in your photos or videos must not contain inappropriate language.
  • Distorting the original context of an image or video is strictly prohibited.
  • You acknowledge that you are solely responsible for the content you write and upload. We bear no responsibility for any consequences arising from your images or videos.

  • You warrant that:

    • You are the sole creator and owner of the content.

    • The content does not infringe on any third-party rights.

    • Any individuals depicted in your content have provided appropriate model releases, if applicable.

 

6. PAYMENTS AND COMMISSIONS

  • Contributors earn a commission per download or license sale. Rate is 40% and may change without notice.

  • Payouts are made via PayPal, subject to minimum withdrawal thresholds and processing times.

  • Customers pay for content through Stripe, a secure third-party payment processor. Punctum News does not store customer payment details.

 

7. SUBSCRIPTIONS AND SINGLE DOWNLOADS

  • Customers may choose between subscription plans or single purchases.

  • Subscriptions automatically renew unless canceled prior to the renewal date.

  • No refunds are offered for unused downloads or partial subscription periods.

 

8. INTELLECTUAL PROPERTY

All content on the Website, including uploaded media, logos, site code, and layout, is protected by intellectual property laws. You may not copy, modify, or distribute any material except as expressly permitted under your license.

 

9. TERMINATION

  • Punctum News reserves the right to suspend or terminate any user account found in violation of these Terms.

  • Contributors may remove content at any time, but existing licenses granted to customers will remain valid.

 

10. DISCLAIMERS AND LIMITATION OF LIABILITY

  • All content is provided "as is" without warranty of any kind.

  • Punctum News does not guarantee uninterrupted access to the Website.

  • To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages.

 

11. MODIFICATIONS

We reserve the right to update these Terms at any time. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.

 

12. ATTRIBUTION AND USE GUIDELINES

  • Photographer Credit: When using content from Punctum News, customers must provide visible credit to the original creator in the following format whenever reasonably possible:
    PhotographerName/PUNCTUM NEWS or PhotographerName/PUNCTUM.

  • Content Integrity: Altering or manipulating the content (e.g., through retouching, adding/removing elements, or distorting context) is strictly prohibited.

  • Permissible Cropping: Minor cropping or resizing is allowed only for layout or formatting purposes (e.g., fitting an image into your website or publication design), provided it does not alter the original meaning or editorial context of the image.

Failure to comply with these usage guidelines may result in the termination of your license and/or account and potential legal action.

 

13. GOVERNING LAW

These Terms and Conditions are governed by and construed in accordance with the laws of Greece, including but not limited to the Greek Civil Code, Law 2251/1994 on Consumer Protection, Law 2121/1993 on Copyright, and the General Data Protection Regulation (EU) 2016/679 (GDPR), where applicable.

If you access or use the Website from outside Greece, you are responsible for compliance with all local laws. Nothing in these Terms shall override mandatory consumer rights provided under the laws of your country of residence.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Athens, Greece, unless otherwise required by applicable consumer protection laws.
